The Republic of Cyprus is a full member of the European Union since 1st May 2004 and pursuant to Article 1(1) of Protocol 10 of the Act of Accession, the application of the acquis has been suspended in the areas of the Republic of Cyprus in which the Government of the Republic of Cyprus does not exercise effective control.
In order to regulate this situation, the Council has adopted the regulations (EC) No.866/2004 of 29/04/2004, on a regime under Article 2 of Protocol 10 to the Act of Accession and, Reg. (EC) No. 1480/2004, laying down specific rules concerning goods arriving from the areas not under the effective control of the Government of Cyprus in the areas in which the Government exercises effective control. According to article 4 of the Regulation (EC) No. 1480/2004, the movement of counterfeit and pirated goods from persons who cross the line at the crossing points, is prohibited.
Based on the above, the authorities of the Republic of Cyprus shall ensure that goods crossing the line comply with the EC rules on the prohibition on the bringing in of counterfeit and pirated goods. Therefore, the Department of Customs & Excise of the Republic of Cyprus carries out selective checks on goods / items carried by persons crossing the line at the authorised crossing points destined to the free areas. In case where goods are suspected that may violate intellectual property rights are detained, in order to verify their authenticity in cooperation with the Right holders.
If the authenticity of the goods which have been detained is confirmed, then they are returned to their owner but if not, the Department proceeds with their destruction, in accordance with Article 16 of the Control of Goods Infringing Intellectual Property Rights Law no. 133 (I) / 2006 (only in greek).
