Examination of complaints - competent authorities for receiving and investigating complaints

The legal framework for protecting whistleblowers

On February 4, 2022, the 2022 Law on the Protection of Persons Reporting Violations of Union and National Law (Law 6(I)/2022) was published. The law provides protection to individuals who report specific violations of European Union law, acts or omissions related to the commission or potential commission of a criminal offense, or a person's non-compliance with legal obligations, including violations likely to cause environmental damage.

Those entitled protection include persons reporting violations of European Union or national law, third parties associated with the reporters, and legal persons related to or employing the reporters. The Law also defines the conditions for the protection of persons making a report. Both private and public sector entities are required to establish channels and procedures for internal reporting of violations. Protection is also provided to those making public disclosures of violations under certain conditions, with an obligation of confidentiality regarding the reporter's identity. Measures are established to protect the reporting person from retaliation and support them, as well as to penalize offenses such as obstructing the submission of a report, retaliating against a reporter, initiating abusive proceedings, breaching confidentiality, and submitting false reports or disclosures.
