Keeping books and records

Article 43 and Annex Ten to the VAT Law requires all taxable persons to keep books and records and to retain them for at least six (6) years after the entries were made or the transactions reported in them were completed, unless the Commissioner of Taxation stipulates otherwise in a notice to the interested party.

Every registered person must keep books and records for all taxable supplies of goods and/or services which are conducted or take place during the course of their business and for all intra-Community transactions carried out. The books and records must be up to date, must be adequately informative and must enable the businessman to calculate the amount of tax which he must pay or may be credited and to fill in the necessary tax returns.

The records must be kept in a form that enables officers of the Tax Department to verify if the tax owed was paid correctly. However, the way in which they are kept must not conflict with business practices. The law also includes specific rules on the books and records to be kept for special schemes such as the retail scheme, the profit margin scheme, etc.

Taxable persons must keep or retain the books and records provided for by law at the business’s head office.
